The loss of a family member is usually a difficult and stressful time for family and friends. Many people appoint family members or friends as their Executor when they make their Will not realising the additional burden they are placing on them at an often difficult time.
The natural inclination is to appoint an adult family member or trusted friend as Executor. Those appointed feel duty bound to undertake the task but may not fully understand the complexity of the role. Where there is no Will (Intestate) an Administrator who must be at least 18 years of age is appointed by the court. It can be difficult to establish who should and can apply for administration of the deceased’s estate. The estate must be administered as required by law and the Administrator can be held personally responsible for failing to do so.
The administration of an intestate estate takes on another dimension as not only is an Administrator responsible for the often complex duties of administering the assets and liabilities but is also required to establish who the beneficiaries are.
The entitlement of beneficiaries is determined pursuant to an act of Parliament and if the assets of the estate require formal administration the determination of who is entitled is presented to the Supreme Court for their approval when an application is made.
De facto partners of any sex now have a right to claim an interest in an estate of their partner; however certain criteria must be satisfied.
